Some of the best original characters are rip-offs. Perhaps Disney is so litigious because it remembers that Mickey Mouse himself only exists because Walt needed a replacement for Oswald the Lucky Rabbit, who he didn't own. So no copyright [or is it trademark?] laws, no Mickey Mouse. Weird if you think about it that way.
