Content Usage / License Agreement [v.1.3]

The Personal Use License Agreement applies to anyone that uses our content without a commercial license. This includes but is not limited to:
(1) Members of the PeaPu Patreon subscribed at tiers with the description of "Personal Use".
(e.g., Tier 1 Boop Patrons or Tier 2 Boopantry Patrons).
(2) Users who purchase PeaPu Content on other platforms
(e.g., purchases made from CartographyAssets, Gumroad, Roll20, The Forge, or similar platforms)
(3) Users who download publicly available (free) PeaPu Content
(e.g., individuals who access content without purchase or subscription).

The Personal Use License Agreement allows for the following:
(1) You may print and use PeaPu Content, such as maps, tokens, or assets, for your personal tabletop games.
(2) You may use PeaPu Content online in virtual tabletops such as but not limited to: Roll20, Fantasy Grounds, and Foundry VTT.
(3) You may use PeaPuContent to create non-profit products: free adventures, settings, campaigns, worlds, or articles on platforms such as World Anvil. These non-profit products must remain free in perpetuity and may not be converted into paid products, even if you later acquire a commercial license.

Commercial Exceptions to the Personal Use License:
This is a list of exceptions that apply to the Personal Use License Agreement that allow minor forms of commercialization.
(1) Paid Game Masters
You may use PeaPu Content to create maps or other materials for personal tabletop games you run as a paid game master. For example, if you charge a fee for your storytelling services and use maps incorporating PeaPu Content in those games, no commercial license is required.
(2) Streaming & Youtube
You may use PeaPu Content, whether free or exclusive, in transformative video content streamed or uploaded to platforms including but not limited to Twitch, YouTube, or Odysee. For example, if you stream a weekly tabletop role-playing game with friends or paying players using maps made with PeaPu Content and earn revenue through subscriptions or donations, this use is permitted without a commercial license.
(3) Amateur Commission Artists
You may use PeaPu Content irregularly in commissioned works without a commercial license, provided such use does not constitute the majority of your projects. For example, if someone pays you to create a map incorporating PeaPu Content and this is an occasional activity, no commercial license is required. However, if you regularly rely on PeaPu Content for your commissions, you must acquire a commercial license.

Limited Commercial Use License Agreement
This Limited Commercial Use License Agreement applies to individuals who have acquired a commercial license by subscribing to a PeaPu Patreon tier that explicitly permits commercial use, as stated in the tier description.
Subscription to such a tier is currently the only method of obtaining a commercial license for PeaPu Content.Subscribing
Upon subscribing to a commercial tier, this Agreement applies to all commercial products you create using PeaPu Content going forward.Unsubscribing
If you end your subscription to a commercial tier on Patreon, you may no longer produce new commercial products using PeaPu Content. However, products created during your active subscription to a commercial tier remain covered under this Agreement and retain their commercial rights.Usage
Under this Agreement, you may use any PeaPu Content to which you have access—whether publicly available (free) or exclusive—in your commercial products, subject to the limitations outlined in this Agreement. This includes, but is not limited to,:
creating modules, adventures, campaigns, books, and maps related to tabletop role-playing games. These products may be sold on platforms including, but not limited to, DMs Guild, DriveThruRPG, Roll20, The Forge, and CartographyAssets.
Attribution
You must include attribution in any created content that uses PeaPu Content. Attribution is defined as information sufficient for an end-user to locate PeaPu Content on an official marketplace.
Examples:
"This product was made using assets created by PeaPu "
"Made this cool map using PeaPu Content; find them here: https://cartographyassets.com/creator/peapu/
"Assets used in this map are credited here (hyperlink to a page listing PeaPu and among other contributors)."
Third-party Commercial Use
Work you create using PeaPu Content belongs to you, and you may grant a commercial license to third parties for its use. However, third parties may not resell your work "as is" and must incorporate it into a larger project, such as a book, adventure module, or campaign.
For example, you may sell your map to a third party who then includes it in a published module, but they cannot resell the map standalone. To resell your work independently, the third party must:
Subscribe to a commercial tier on our Patreon (www.patreon.com/PeaPu
Comply with this Agreement, and obtain your permission to sell the work.
Third parties must also provide attribution to [Your Company/Creator Name] in their use of your work. For example:

Commercial Use Restrictions
The Limited Commercial Use License Agreement and Personal Use License Agreement cover most permissible uses of PeaPu Content. However, the following restrictions apply and are not covered by these agreements:
Large Businesses
If you operate a business generating over $25,000 annually in sales revenue and intend to use PeaPu Content, you are not authorized to do so under the above license agreements. Instead, you must contact us directly via available channels to negotiate a separate agreement.
Redistribution as Art
You are not authorized to redistribute PeaPu Content, in part or in whole, whether free or for sale, as art displays, part of an art collection, print-on-demand designs, or for mass distribution or production.Artificial Intelligence
You may not use or modify PeaPu Content with any generative artificial intelligence programs, including but not limited to Stable Diffusion, Midjourney, and DALL-E. This restriction also prohibits training AI programs on PeaPu Content.
Creation and Sale of Custom Assets or Tokens
While you may create and sell products using PeaPu Content under the Limited Commercial Use License Agreement, you may not create or sell custom assets, tokens, or other content derived from PeaPu Content that competes with our offerings. For example, you may not assemble and commercialize a set of cars, buildings, alien creatures, or prefabs made using PeaPu Content. Additionally, while you may modify PeaPu Content for personal use, you may not share that modified content publicly, except on the official PeaPu Discord server.Contact Us

Modifications to the Agreement
We reserve the right to revise or modify the terms of this Agreement at any time. All such modifications will become effective immediately unless otherwise specified. Notification of changes will be provided through Patreon.
All PeaPu Content remains the property of PeaPu. The licenses granted under this Agreement do not transfer ownership of PeaPu Content to you or any third party.

I don't see why it wouldn't be legal. I know in the software world there's the General Public License which basically states that you can use the stuff but it always has to be free even if you modify it. For the free products, I just kinda hoped that if people make something for free, they make sure it stays that way. I think if it came down to a legal case in court, you'd have a hard time proving that one small change made it an entirely different product. I think the reason for all this legalese is mostly to make it harder for large companies to go in and abuse the system. Granted, its not full-proof but maybe just enough to deter some of the lazy bad players. Most of the time, if you just message me and say what you wanna do commercially I'm likely to agree. Fantasy definitely does have that escapist appeal. We even dumb down the actual crazy stuff that did happen in the medieval times to reduce complexity, cause lord know we have enough of it in our lives already :D

I have no issue here ( I dont even use the products. Just a happy supporter), but am curious if "These non-profit products must remain free in perpetuity and may not be converted into paid products, even if you later acquire a commercial license." is even legal? Obviously not practical bc they could add 1 line and say it is a new product, and it is. But even without cheesing it, this is strange to include. I assume it is to prevent ppl from paying 1 commercial license one month then mass converting hundreds of products? I guess it just shows how silly licensing often is in the first place, once you get past the super basics of commercial/non-commercial. It's mostly to keep honest people honest. Which ironically are the only ppl who you don't need legalese to work with, hahaha. This world is so whacky. Makes me wonder if that is why fantasy appeals to so many? A simpler more practical era, perhaps. Likely more honest a time to live, too! (Medieval times)

That's absolutely fine. The example was more to indicate a pretty good way of doing it. Naturally, platforms will have their own rules and limitations so sharing links is not always possible.

As a precision, it is not possible to add on a product page an Url link on DriveThruRPG which sends to an external website. So I write that it was made with assets from PeaPu on Patreon.
